An alleged acquantance rape at the Sigma Alpha Epsilon fraternity house was reported to have occurred between the hours of 2 a.m. and 12 p.m. Sunday, Nov. 1, but charges have not been filed because the victim reported the rape anonymously and has requested that no investigation take place, UA Police Department officials said.
“We’ve never had an anonymous report on a rape before,” said Lt. Gary Crain, UAPD public information officer. “This is the first time we’ve gotten this type of report where the person who made the report made it anonymously and wants nothing done and requested no investigation be done.”
Crain said the victim had undergone a rape examination, so in the event she changes her mind later the UAPD will have that evidence.
Because the Clery Act requires that colleges and universities fully disclose all crime statistics, the alleged rape appeared in the Daily Crime Log sent out by the UAPD and will be counted in the yearly statistics.
“We’re not really sure how we’re going to proceed with this, as there is some contradictory information on what has to be done,” Crain said. “Can the police department know about a crime and not investigate it? On the other hand, if someone reports a crime anonymously, how do we follow it up?”
According to Crain, the individual has indicated to police that the alleged perpetrator in the crime is an acquaintance and she never wants her parents to find out about the situation, and that is her reason for asking that charges not be filed.
“This is a tough one,” Crain said. “We’re still hashing through what the law states because there are some contradictions.”
